A Louisiana man is suing the state for injuries he suffered through a work release program with the Louisiana Department of Corrections in 2010. At the time, he was a trustee assigned to North Vermillion High School.
The plaintiff was painting and could not reach an area without a ladder, which was not available. He allegedly requested a ladder several times, but his supervisor told him to complete the job using whatever was available. He stood on a 50-gallon drum and a five-gallon bucket and then slipped and fell. He is suing the state based on the following:
- Failure to provide a safe working environment
- Failure to provide him with proper and safe instruments to do his work
- Failure to do what it should have done under the circumstances
- Failure to take precautionary measures to prevent the accident
The plaintiff allegedly suffers severe pain and suffering, stiffness, limitation of motion, residual function and loss of enjoyment of life. He is suing for past, present and future medical expenses, which will be determined at a later date. He is also suing for past, present and future lost wages and loss of earning capacity.
