Painter Sues Paint Manufacturers for Harmful Benzene Exposure

A man claiming his years as a painter exposed him to benzene and resulted in his multiple myeloma diagnosis, filed suit against manufactures of the benzene-containing products in New Orleans federal court last month.

From 1981 to 2005, the plaintiff worked as a painter at various sites for the defendants. During that time, he alleges exposure to benzene-containing products in paints, solvents, primers, thinners and other paint products. He claims his exposure to the harmful chemical resulted in his March 2010 multiple myeloma diagnosis.

He is accusing the defendants of negligence, failing to warn users about the hazards associated with benzene-containing paint products and misrepresenting the safety and health risks of the products. The plaintiff also alleges violations of strict product liability and liability under the Louisiana Products Liability Act.

The plaintiff seeks damages for physical pain and suffering, mental anguish, emotional distress, disfigurement, embarrassment, lost earning capacity, physical and mental disability, medical expenses, loss of enjoyment of life, fear of cancer, loss of society and consortium, wrongful death damages and survival damages.
