Railroad Worker suffers work injury and sues for damages

A railroad worker filed a personal injury lawsuit last month against New Orleans Public Belt Railroad Commission. The plaintiff claims that while working for the defendant, a piece of steel broke off and entered his left calf. He says the steel in his leg remained undetected for two weeks, and he developed a staph infection.

According to the complaint filed in New Orleans federal court, the plaintiff was operating a sledgehammer to secure “E” clips. The steel sliced into his calf and he could not walk for three weeks. He subsequently required surgery to remove the steel from his calf.

The plaintiff accuses the defendant of negligence for failing to provide a safe place to work, violating the Federal Employer’s Liability Act, failing to provide proper tools and equipment and failing to warn him of the unsafe work conditions.

He seeks damages for his physical pain and suffering, loss of enjoyment of life, lost wages and medical expenses.
