New Orleans Refinery Worker Files Discrimination Suit against Employer

A worker claiming that a pattern of harassment and intimidation by his employer caused his long-term disability filed suit last month in New Orleans federal court. The man worked at Valero Refining since 1998.

The plaintiff started as a pipefitter in the maintenance department before receiving a promotion to supervisor in October 2001. His lawsuit claims denial of equal access to overtime opportunities in favor of white employees. He also alleges intimidation tactics and racial slurs in the workplace.

The plaintiff reported that a contractor refused to do his job duties in December 2009. The contractor filed a sexual harassment grievance against the plaintiff, and the defendant placed the plaintiff on immediate suspension. The plaintiff claims that the incidents of harassment and intimidation caused work-related stress and required medical treatment. In January 2011, physicians placed him on long-term disability.

His lawsuit seeks damages for intentional infliction of emotional distress, bad-faith breach of contract damages, lost benefits, mental anguish, humiliation, loss of enjoyment of life, compensatory damages, punitive damages plus attorney’s fees and costs.
