Ship Worker Sues Employer for Severely Injured Knee

A vessel worker filed suit against his employer for injuries her suffered while trying to climb onto a small skiff. The plaintiff sued PBC Management last month in New Orleans federal court. The accident occurred in May 2009.

The plaintiff was a crewmember on the defendant’s vessel in Galveston Bay. According to his complaint, the captain lowered a small skiff into the rough seas. The plaintiff fell to the bottom of the skiff while attempting to transfer from the vessel. He suffered a serious injury to his right knee.

The plaintiff claims that the defendant failed to provide him with a safe way of transporting to the skiff, failed to provide him with a competent crew, failed to provide a safe work environment, failed to provide a seaworthy vessel and failed to properly navigate the vessel for unloading operations.

He is asking the court for damages for physical and mental pain and suffering, loss of income and loss of earning capacity. In addition, he is seeking money for medical expenses, compensatory and exemplary damages plus interest and attorney’s fees.
