Pizza Chef Wants His Cut of the Pie for Overtime Worked

Any way you slice it, a New Orleans pizza chef just wants payment for the hours he worked at a Louisiana restaurant and bar. The employee filed a lawsuit against Sunrise Entertainment earlier this month in New Orleans federal court claiming violations of the Fair Labor Standards Act, according to The Louisiana Record.

The plaintiff began working as a cook for the defendant in May 2010. According to his complaint, whenever he worked overtime, the defendant would pay him in cash at his normal hourly rate. The plaintiff alleges that the defendant did this to purposely obscure from the government and his employees his obligations and liabilities to pay overtime according to the Fair Labor Standards Act.

The plaintiff accuses Sunrise Entertainment of violating the federal law with reckless disregard. He wants the overtime pay that the defendant rightfully owes him, front pay, attorneys fees, liquidated damages, court costs and interest.  

You have to give credit to the plaintiff in this case. Anyone who has ever spent time in the service industry can probably tell a story or two about missed paychecks and less-than-honest managers. The plaintiff had the awareness and knowledge to know that his manager’s actions were violating his rights as an employee.
