Judge Questions Some Plaintiff’s Credibility in Yaz Class Action Case

Discrepancies in some plaintiffs’ fact sheets prompted the federal court judge to allow Bayer to depose 100 plaintiffs in the Bayer Yaz class action lawsuit. Bayer can then compare their deposition testimony with the fact sheets submitted by the plaintiffs’ attorneys.

In a report at madisonrecord.com, the judge found errors and omissions when he examined some of the fact sheets, including misidentifying doctors and failing to name the pharmacy where the plaintiff filled the prescription. The mistakes raise questions about some plaintiffs’ credibility, said the judge.

The judge hopes that the depositions will produce accurate information that could lead to a resolution of the Yaz and Yasmin litigation. Currently, there are approximately 6,400 lawsuits in federal courts stemming from allegations that the Yaz and Yasmin birth control pills led to blood clots, strokes and in one case, the death of a college student who took the pill to control her acne.

An earlier blog post here detailed the bellwether trials that are set for this fall in the matter. There is no word as to how long the 100 depositions will take, or if they will delay the start of the trials in any way.
