A Shopping Cart Accident at Winn-Dixie

A shopping cart and a pothole resulted in severe injuries to a woman last September in Slidell. She is now suing the Winn-Dixie grocery store where the accident occurred, according to louisianarecord.com.

According to the woman’s complaint in New Orleans federal court, she was pushing the shopping cart through the Winn-Dixie parking lot. The cart’s wheel hit a hole in the pavement, causing the cart to flip. She fell on top of the cart and then hit the ground. She suffered injuries to her knee, hip and back, according to her lawsuit.

She accuses Winn-Dixie of creating an unreasonably dangerous condition in the parking lot, and for failing to correct it. She asks the court for damages for mental anguish and distress, physical pain and suffering, medical bills, loss of enjoyment of life and loss of society, among other damages.

Although it may seem trivial, shopping carts cause thousands of injuries each year in the United States. According to the U.S. Consumer Product Safety Commission (CPSC), there were 22,200 reported shopping cart injuries in 1996. From 1995 to 1996, over 21,000 children under the age of 5 sought treatment in emergency rooms for shopping car injuries.
