Falling Prices and Shoppers: Kmart Sued for $900,000 in Slip and Fall

A patch of water at a Mandeville Kmart store is the cause of a shopper’s $900,000 claim for damages in a slip and fall accident last September. The St. Tammany Parish woman filed the lawsuit earlier this month, which Kmart removed to federal court in New Orleans.

According to a report at louisianarecord.com, there was a large patch of water inside the store between the checkout lanes and the drink machine. The plaintiff slipped in the water, which was in plain view to the cashiers on duty, according to the complaint.

The plaintiff requests $900,000 in damages for lost wages, medical expenses, loss of earning capacity, physical suffering, mental anguish, emotional distress, disfigurement, disability and scarring plus interest.

Property owners have a duty to keep their premises safe for visitors. An owner or business has a duty to correct anything that could cause harm or injury to someone, especially when the hazard is in plain sight. While some think a slip and fall is a relatively minor injury, it can be serious depending on the impact and the age and physical condition of the victim.

Slip and fall victims often feel the impact on their knees, wrists and elbows. When joints and bones impact a hard floor or concrete, the pain can be severe and the injuries can be permanent.
