Injury and Embarrassment at the Dollar Tree Store

A 55-year-old woman not only suffered injuries in a slip and fall accidentinside a Dollar Tree Store, but she reportedly suffered embarrassment when her dress left her exposed to other customers and employees. She is now suing the Dollar Tree Stores, Inc., in federal court in New Orleans over the incident that happened last month in New Orleans.

As reported at louisianrecord.com, the woman was in the store when she allegedly slipped on a slick liquid on the store floor. She landed and suffered an injured hip and knee, according to her complaint. In addition, when she landed her dress fell in such a way that left parts of her body exposed while she lay there injured. Her grandson was there and rearranged her dress before help arrived.

The woman said that store employees did not help her after the accident. She accuses the store of negligence for failing to clean the floor. She is also accusing the store of negligence for failing to assist her after she fell, which allegedly caused her embarrassment and emotional trauma.

This is a slip and fall incident that seems to have caused injury and embarrassment. Should the plaintiff recover additional damages for the embarrassment of being exposed by her dress after her fall?
