Railing Breaks and Woman Falls from Balcony

A Louisiana woman visited a friend at her condominium and fell from a second floor balcony. She is now suing the condo association for the alleged faulty railing that gave way and caused her to fall, as reported at louisianarecord.com. The woman was standing on the balcony when she leaned against the railing. The railing broke from the wall of the balcony and she fell to the ground. The plaintiff suffered a fractured spine and other severe injuries.

When hazardous conditions exist on someone’s property, the property owner has a legal obligation to remedy the condition to prevent injuries to others. In the above case, the condo association had a duty to fix the railing if they knew it was loose and in danger of breaking from the wall. The railing manufacturer could also be liable for making a defective railing.
